We at Learngah (“Learngah”, “we”, “us”) respect your privacy and want you to understand how we collect, use, and share data about you. This Privacy Policy covers our data collection practices and describes your rights to access, correct, or delete your personal data.
Unless we link to a different policy or state otherwise, this Privacy Policy applies when you visit or use the Learngah website, mobile application, APIs or related services (the “Services”). It also applies to prospective customers of our business and enterprise products.
By using the Services, you agree to the terms of this Privacy Policy. You shouldn’t use the Services if you don’t agree with this Privacy Policy or any other agreement that governs your use of the Services.
1. What Data We Get
We collect certain data from you directly, like information you enter yourself while registering, signing up and while you download, purchase or access content at Learngah.
2. Data You Provide to Us
We may collect different data from or about you depending on how you use the Services. Below are some examples to help you better understand the data we collect.

- Account Data
In order to use certain features (like accessing content), you need to create a user account. When you create or update your account, we collect and store the data you provide, like your email address, password, phone number, occupation, skill interests, gender, race, ethnicity, government ID information, verification photo, age, date of birth, and account settings.

You can also choose to provide profile information like a photo, headline, biography, language, website link, social media profiles, country, or other data. Your Profile Data may be publicly viewable by others.

- Shared Content
Parts of the Services let you interact with other users or share content publicly, including by posting reviews about content, asking or answering questions, sending messages to students or instructors, or posting photos or other work you upload. Such shared content may be publicly viewable by others depending on where it is posted.

- Educational Content Data
When you access content, we collect certain data including courses, assignments, labs, workspaces, and quizzes you’ve started and completed; content purchases and credits; subscriptions; completion certificates; your exchanges with instructors, sellers, and other students; and essays, answers to questions, and other items submitted to satisfy course and related content requirements. If you are an instructor, we store your educational content which may contain data about you.

- Student, Customer Payment Data
If you make purchases, we collect certain data about your purchase (such as your name and ZIP code) as necessary to process your order. For security, Learngah does not collect or store sensitive cardholder data, such as full credit card numbers or card authentication data.

- Seller Payment Data
If you are a Seller, you may have to provide your payment account details to receive payments. If you link a payment account or provide account details, we collect and use certain information, including your payment account email address, account ID, physical address, or other data necessary for us to send payments to your account. For security, Learngah does not collect or store sensitive bank account information. The collection, use, and disclosure of your payment, billing, and taxation data is subject to the privacy policy and other terms of your payment account provider.

We use cookies, which are small text files stored by your browser, to collect, store, and share data about your activities across websites, including on Learngah. They allow us to remember things about your visits to Learngah, like your preferred language, and to make the site easier to use. Learngah and service providers acting on our behalf (like Google Analytics and third-party advertisers) use server log files and automated data collection tools like cookies, tags, scripts, customized links, device or browser fingerprints, and web beacons (together, “Data Collection Tools“) when you access and use the Services. These Data Collection Tools automatically track and collect certain System Data and Usage Data when you use the Services. In some cases, we tie data gathered through those Data Collection Tools to other data.

Learngah uses the following types of Data Collection Tools for the purposes described:

These Data Collection Tools enable you to access the site, provide basic functionality (like logging in or accessing content), secure the site, protect against fraudulent logins, and detect and prevent abuse or unauthorized use of your account. - Manage your account and account preferences.
- Facilitate the Services’ technical functioning, including troubleshooting and resolving issues, securing the Services, and preventing fraud and abuse.
- Solicit feedback from users.
- Market products, services, surveys, and promotions.
- Market Subscription Plans to prospective customers.
- Learn more about you by linking your data with additional data through third-party data providers and/or analyzing the data with the help of analytics service providers.
- Tailor advertisements across devices for both onsite and offsite.
- Improve our Services and develop new products, services, and features.
- Analyze trends and traffic, track purchases, and track usage data.
- Advertise the Services on third-party websites and applications.
6. Who We Share Your Data With
We share certain data about you with instructors, sellers, other students, companies performing services for us, Learngah business partners, analytics and data enrichment providers, companies helping us run promotions and surveys, and advertising companies who help us promote our Services. We may also share your data as needed for security, legal compliance, or as part of a corporate restructuring. Lastly, we can share data in other ways if it is aggregated or de-identified or if we get your consent.

We share data that we have about you with instructors or sellers for content you access or request information about, so they can improve their content or process order for you and other students and customers. This data may include things like your city, country, contact number, province, zip code etc.

We share your data with third-party companies who perform services on our behalf, like payment processing, fraud and abuse prevention, data analysis, marketing and advertising services, email and hosting services, and customer services and support. - With Analytics and Data Enrichment Services
As part of our use of third-party analytics tools like Google Analytics, we share certain contact information and Account Data. We do this to communicate with you in a more effective and customized manner.

- To Administer Promotions & Surveys
We may share your data as necessary to administer, market, or sponsor promotions and surveys you choose to participate in.

- For Advertising
Learngah may use an advertising-supported revenue model, we may use and share certain System Data and Usage Data with third-party advertisers and networks to show general demographic and preference information among our users. This data will be used to offer you targeted ad delivery to personalize your user experience, and to undertake web analytics.

- For Security & Legal Compliance
We may disclose your data to third parties if we (in our sole discretion) have a good faith belief that the disclosure is; permitted or required by law, requested as part of a judicial, governmental, or legal inquiry, order, or proceeding, reasonably necessary as part of a valid subpoena, warrant, or other legally-valid request, reasonably necessary to enforce our Terms of Use, Privacy Policy, and other legal agreements, required to detect, prevent, or address fraud, abuse, misuse, potential violations of law (or rule or regulation), or security or technical issues, reasonably necessary in our discretion to protect against imminent harm to the rights, property, or safety of Learngah, our users, employees, members of the public, or our Services, we may also disclose data about you to our auditors and legal advisors in order to assess our disclosure obligations and rights under this Privacy Policy.

- During a Change in Control
If Learngah undergoes a business transaction like a merger, acquisition, corporate divestiture, or dissolution, or a sale of all or some of its assets, we may share, disclose, or transfer all of your data to the successor organization during such transition or in contemplation of a transition.
7. Security
Learngah takes appropriate security measures to protect against unauthorized access, alteration, disclosure, or destruction of your personal data that we collect and store. These measures vary based on the type and sensitivity of the data. Unfortunately, however, no system can be 100% secured, so we cannot guarantee that communications between you and Learngah, the Services, or any information provided to us in connection with the data we collect through the Services will be free from unauthorized access by third parties. Your password is an important part of our security system, and it is your responsibility to protect it. You should not share your password with any third party, and if you believe your password or account has been compromised, you should change it immediately and contact our Support Team with any concerns.
8. Accessing, Updating, and Deleting Your Personal Data

- You can access and update your personal data by logging in to your account and updating the changes in your profile or other fields where you deem necessary.
- To delete or terminates account at Learngah, write an email stating the termination of your account along with providing your account details.
Learngah is established with the sole aim of providing online learning platform so that people can share their knowledge & skills with other all across Pakistan. There are three main types of people coming to the Learngah website for different purposes, these people are; Learners (also known as students or customers) who enroll themselves into online courses provided and download educational and other academic content from the website, Tutors (also called Instructors) who publish their educational courses at Learngah and Document Sellers who publish their academic and non-academic products such as notebooks, past papers and handbooks etc.
In order to make this website and related services safe secure for all of us, learners, tutors and sellers, we (Learngah) need rules and regulation to be enforced upon the website users. These Terms apply to all your activities on the Learngah website, the Learngah mobile applications, our APIs, and other related services (“Services”). If you publish or sell a course or other product on the Learngah platform or sell documents (such as notes, handbooks, past papers etc.), you are required to agree to the Seller Terms. We also provide details regarding our processing of personal data of our students and Sellers (Tutors and Document Seller) in our Privacy Policy.
1. Accounts
You need an account for most activities on our platform, including to purchase and access content or to submit content for publication. Keep your password somewhere safe, because you’re responsible for all activity associated with your account. If you suspect someone else is using your account, let us know by contacting our Support Team. You must have reached the age of consent for online services in your country to use Learngah.
When setting up and maintaining your account, you must provide and continue to provide accurate and complete information, including a valid email address. You have complete responsibility for your account and everything that happens on your account, including for any harm or damage (to us or anyone else) caused by someone using your account without your permission. This means you need to be careful with your password. You may not transfer your account to someone else or use someone else’s account. If you contact us to request access to an account, we will not grant you such access unless you can provide us with the information that we need to prove you are the owner of that account. In the event of the death of a user, the account of that user will be closed.
You may not share your account login credentials with anyone else. You are responsible for what happens with your account and Learngah will not intervene in disputes between students or instructors who have shared account login credentials. You must notify us immediately upon learning that someone else may be using your account without your permission (or if you suspect any other breach of security) by contacting our Support Team. We may request some information from you to confirm that you are indeed the owner of your account. Under our Seller Terms, you may be requested to verify your identity before you are authorized to submit content for publication on Learngah. You can terminate your account at any time, check our Privacy Policy to see how you can terminate your account.
2. Content Purchase, Download & Enrollment
When you enroll in a course or given access to document or other content, you get a license from us to view it via the Learngah Services and no other use. Don’t try to transfer or resell content in any way. We generally grant a lifetime or expirable access license. In certain circumstances we must disable the content because of legal or policy reasons or for enrollments via Subscription Plans etc.
Under our Seller Terms, when tutors or document sellers publish content on Learngah, they grant Learngah a license to offer a license to the content to students & customers. This means that we have the right to sublicense the content to the authorized students and customers. As a student or customer, when you enroll in a course or other content or given access to the content, whether it’s free or paid content, you are getting a license from Learngah to view the content via the Learngah platform and Services, and Learngah is the licensor of record. Content is licensed, and not sold, to you. This license does not give you any right to resell the content in any manner.
In addition to students who purchase content online, Learngah also allows the Tutors to manually enroll students they teach in physical classes at their institutes to ensure they get the chance to online education as well.
3. Payments & Refunds
When you make a payment, you agree to use a valid payment method. If you aren’t happy with your content, Learngah offers a 5-day refund period for courses sold online and provides refund for downloadable content (uploaded by Document Sellers) only if the downloaded content does not match the description provided in the product (document) page.
Depending upon the payment method being selected, payments can either be managed by Learngah or by the Sellers (Tutor or Document Sellers) directly. Learngah is only responsible for the payments managed by it, for all payments managed by Sellers (e.g. cash on delivery, jazz cash and easy paisa etc.), Sellers will be responsible for payment and refund management. In case any complaint, related to payments and refund found to be authentic against Sellers, it can lead to the Seller’s account suspension or account termination.
4. Pricing
Sellers (both Tutor and Document Seller) are responsible for pricing (in PKR) their content as they deem suitable. Sellers are also allowed to sell their content for free or to sell it at discounted price through coupons and discounts. In addition, if any discounts are put in place by Learngah for marketing and promotion purposes, then they will be accepted by the Sellers and if they have any concerns they can share with the Learngah to resolve the matter.
5. Payments & Refunds
You agree to pay the fees for content that you purchase, and if you choose to pay through debit or credit card, you authorize us to charge your debit or credit card along with transaction charges and if you choose to pay through other means of payment such as Cash on Delivery, Jazz Cash or Easy Paisa etc. then this payment will be handled by respective Seller (they will have your billing and contact details in order to request payment to allow product purchase) whose product you are purchasing. Learngah works with payment service providers to offer you the most convenient payment methods to keep your payment information secure.
When you make a purchase, you agree not to use an invalid or unauthorized payment method. If your payment method fails and you still get access to the content you are enrolling in, you agree to pay us the corresponding fees within thirty (30) days of notification from us. We reserve the right to disable access to any content for which we have not received adequate payment.
For all the purchase you make at Learngah, you will have 5 days to make a refund request. All the refund requests will thoroughly be checked and refund will be made to customers through bank transfer or other possible means of payment only if the product they purchase did not match the product description. For example, if a customer purchases an English Language Course but instead the course product contains content which does not match the content displayed, written or mentioned in the product description then the refund request will be approved. Similarly, if a customer purchases Notes for Class 10 and they do not match with the product description then refund can be claimed. In case of direct payment to Sellers such as through Cash on Delivery, Jazz Cash or Easy Paisa etc. Sellers will be liable to make refund to the customers or necessary action will be taken against the Sellers which may lead to account termination. Similarly, all the refund requests made against the purchase payments made to Learngah, and Learngah then depositing that payment to the Sellers’ accounts, will be entertained by Learngah.
Since Learngah is facilitating Sellers to reach prospective customers and students for online learning and document selling, Sellers will be responsible for the taxes they accumulate against their earnings while Learngah will only have to pay the taxes that it incurs against the commission it earns from the purchase transactions (this commission is set to “0” for the time being to facilitate Sellers to provide online learning all across Pakistan).
At our discretion, if we believe you (customer, student or seller) are abusing our refund policy, such as if you’ve consumed a significant portion of the content or have already downloaded the document that you want to refund or if you’ve previously refunded the content, we reserve the right to deny your refund, restrict you from other future refunds, ban your account, and/or restrict all future use of the Services. If we ban your account or disable your access to the content due to your violation of these Terms, you will not be eligible to receive a refund.
6. Content & Behaviour Rules
You can only use Learngah for lawful purposes. Learngah is only providing you with a platform to post and publish your content therefore, you’re responsible for all the content that you post on our platform. You should keep the reviews, questions, posts, courses and other content you upload in line the law, and respect the intellectual property rights of others. Your use of the Services and behavior on our platform must comply with applicable local or national laws or regulations of your country. You are solely responsible for the knowledge of and compliance with such laws and regulations that are applicable to you.
If you are a student or customer who is enrolled in a course or has access to downloadable content published by the Seller, then the Seller can make a request to you to leave feedback, submit content as “assignment” or carry out “test” or “quiz”. Make sure to be very careful and submit content that is relevant to the course or content and do not submit any irrelevant content.
If you are a Seller, you can submit content for publication on the platform and you can also communicate with the customers or students who have enrolled in your courses or accessed other content. In both cases, you must abide by the law and respect the rights of others: you cannot post any course, product, question, answer, review or other content that violates applicable local or national laws or regulations of your country. You are solely responsible for any courses, content, and actions you post or take via the platform and Services and their consequences.
If we are put on notice that your course, product or content violates the law or the rights of others, or if we believe your content, course, product or behavior is unlawful, inappropriate, or objectionable, we may remove your content from our platform and terminate your account.
At Learngah, we take terms and conditions and privacy policy seriously. We may restrict or terminate your permission to use our platform and Services or ban your account at any time, with or without notice, for any or no reason, including for any violation of these Terms, if you fail to pay any fees when due, for fraudulent chargeback requests, upon the request of law enforcement or government agencies, for extended periods of inactivity, for unexpected technical issues or problems, if we suspect that you engage in fraudulent or illegal activities, or for any other reason in our sole discretion. Upon any such termination we may delete your account and content, and we may prevent you from further access to the platforms and use of our Services. Your content may still be available on the platforms even if your account is terminated or suspended. You agree that we will have no liability to you or any third party for termination of your account, removal of your content, or blocking of your access to our platforms and services.
7. Learngah’s Right to Content
The content you post as a student or Seller (as Tutor or Document Seller) remains yours. By posting courses, documents and other content, you allow Learngah to reuse and share it but you do not lose any ownership rights you may have over your content. You retain ownership of content you post to our platform, including your courses. We’re allowed to share your content to anyone through any media, including promoting it via advertising on other websites. Learngah uses third party services to store website content such as videos, images, files and documents etc. In case of technical or other issue that disrupts the delivery of content from third party content management service, Learngah will not be held accountable or responsible. Therefore, Sellers and students should make sure to keep a copy of their content with them as a backup. Further to this, Sellers (both Tutors and Document Sellers) are encouraged to post content such as videos and document files to the posts, such as course and document products, by uploading the content (videos, images and other such files) to their online clouds and then inserting the links in their posts. This way, if any content delivery issue occurs, it will not disrupt your content delivery (such as videos, images and document files etc.) to the customers.
By submitting or posting content on or through our platform, you grant us a non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your content (including your name and image) in any and all media or distribution methods (existing now or later developed). This includes making your content available to other companies, organizations, or individuals who partner with Learngah for the syndication, broadcast, distribution, or publication of content on other media, as well as using your content for marketing purposes. You also waive any rights of privacy, publicity, or other rights of a similar nature applicable to all these uses, to the extent permissible under applicable law. You represent and warrant that you have all the rights, power, and authority necessary to authorize us to use any content that you submit. You also agree to all such uses of your content with no compensation paid to you.
8. Using Learngah at Your Own Risk
Our platform model means we do not review or edit the content for legal issues, and we are not in a position to determine the legality of content. We do not exercise any editorial control over the content that is available on the platform and, as such, do not guarantee in any manner the reliability, validity, accuracy, or truthfulness of the content. If you access content, you rely on any information provided by the Seller (Tutor and Document Seller) at your own risk.
By using the Services, you may be exposed to content that you consider offensive, indecent, or objectionable. Learngah has no responsibility to keep such content from you and no liability for your access or enrollment in any course or other content, to the extent permissible under applicable law. This also applies to any content relating to health, wellness, and physical exercise. You acknowledge the inherent risks and dangers in the strenuous nature of these types of content, and by accessing such content you choose to assume those risks voluntarily, including risk of illness, bodily injury, disability, or death. You assume full responsibility for the choices you make before, during, and after your access to the content.
When you interact directly with a student or an instructor or document seller, you must be careful about the types of personal information that you share. We do not control what students, document sellers and instructors do with the information they obtain from other users on the platform.
We do not hire or employ the Seller (Tutor or Document Seller) nor are we responsible or liable for any interactions involved between the Seller and students or customers. We are not liable for disputes, claims, losses, injuries, or damage of any kind that might arise out of or relate to the conduct of the Seller or customer, student.
When you use our Services, you will find links to other websites that we don’t own or control. We are not responsible for the content or any other aspect of these third-party sites, including their collection of information about you. You should also read their terms and conditions and privacy policies.
9. Learngah’s Rights
All right, title, and interest in and to the Learngah platform and Services, including our website, our existing or future applications, our APIs, databases, and the content our employees or partners submit or provide through our Services (but excluding content provided by tutors, document sellers, students or customers) are and will remain the exclusive property of Learngah and its licensors.
Nothing gives you a right to use the Learngah name or any of the Learngah trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding Learngah or the Services is entirely voluntary and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.
You may not do any of the following while accessing or using the Learngah platform and Services:

- access, tamper with, or use non-public areas of the platform (including content storage), Learngah’s computer systems, or the technical delivery systems of Learngah’s service providers.
- disable, interfere with, or try to circumvent any of the features of the platforms related to security or probe, scan, or test the vulnerability of any of our systems.
- copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code of or content on the Learngah platform or Services.
- in any way use the Services to send altered, deceptive, or false source-identifying information (such as sending email communications falsely appearing as Learngah); or interfere with, or disrupt, (or attempt to do so), the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the platforms or services, or in any other manner interfering with or creating an undue burden on the Services.
10. Binding Agreement
You agree that by registering, accessing, or using our Services, you are agreeing to enter into a legally binding contract with Learngah. If you do not agree to these Terms, do not register, access, or otherwise use any of our Services.
If you are a Seller accepting these Terms and using our Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so.
If any part of these Terms is found to be invalid or unenforceable by applicable law, then that provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms will continue in effect.
Even if we are delayed in exercising our rights or fail to exercise a right in one case, it doesn’t mean we waive our rights under these Terms, and we may decide to enforce them in the future. If we decide to waive any of our rights in a particular instance, it doesn’t mean we waive our rights generally or in the future.
11. Limitation of Liability
There are risks inherent to using our Services such as loss of you content and other data due to issue in storage management or you or someone else gets inflicted with health issue or injury from the content etc. We will not be liable for any indirect, incidental, punitive, or consequential damages (including loss of data, revenue, profits, or business opportunities, or personal injury or death), whether arising in contract, warranty, tort, product liability, or otherwise, and even if we’ve been advised of the possibility of damages in advance.
12. Relationship Between Us
You and we agree that no joint venture, partnership, employment, contractor, or agency relationship exists between us.
13. No Assignment
You may not assign or transfer these Terms (or the rights and licenses granted under them). For example, if you registered an account as an employee of a company, your account cannot be transferred to another employee. We may assign these Terms (or the rights and licenses granted under them) to another company or person without restriction. Nothing in these Terms confers any right, benefit, or remedy on any third-party person or entity. You agree that your account is non-transferable and that all rights to your account and other rights under these Terms terminate upon your death.
14. No Class Actions
We both agree that we can each only bring claims against the other on an individual basis. This means: (a) neither of us can bring a claim as a plaintiff or class member in a class action, consolidated action, or representative action; (b) an arbitrator can’t combine multiple people’s claims into a single case (or preside over any consolidated, class, or representative action); and (c) an arbitrator’s decision or award in one person’s case can only impact that user, not other users, and can’t be used to decide other users’ disputes. If a court decides that this “No class actions” clause isn’t enforceable or valid, then this “Dispute Resolution” section will be null and void, but the rest of the Terms will still apply.

When you sign up to become a Seller (Tutor or Document Seller) on the Learngah platform, you agree to abide by these Seller Terms & Conditions (“Terms”). These Terms cover details about the aspects of the Learngah platform relevant to the Sellers and are incorporated by reference into our Terms & Conditions, the general terms that govern your use of our Services. Any capitalized terms that aren’t defined in these Terms are defined as specified in the Terms & Conditions
1. Seller Obligations
As a Seller, you are responsible for all content that you post, including documents, lectures, quizzes, coding exercises, practice tests, assignments, resources, answers, course landing page content, labs, assessments, and announcements (“Submitted Content”).
You represent and warrant that:

- you will provide and maintain accurate account information.
- you own or have the necessary licenses, rights, consents, permissions, and authority to authorize Learngah to use your Submitted Content as specified in these Terms and the Terms & Conditions.
- your Submitted Content will not infringe or misappropriate any third party’s intellectual property rights.
- you have the required qualifications, credentials, and expertise (including education, training, knowledge, and skill sets) to teach and offer the services that you offer through your Submitted Content and use of the Services.
- you will ensure a quality of service that corresponds with the standards of your industry and instruction services in general.
You warrant that you will not:

- post or provide any inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, incorrect, infringing, defamatory or libelous content or information.
- post or transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or any other form of solicitation (commercial or otherwise) through the Services or to any user.
- use the Services for business other than providing tutoring, teaching, and instructional services to students.
- engage in any activity that would require us to obtain licenses from or pay royalties to any third party, including the need to pay royalties for the public performance of a musical work or sound recording.
- frame or embed the Services (such as to embed a free version of a course) or otherwise circumvent the Services.
- impersonate another person or gain unauthorized access to another person’s account.
- interfere with or otherwise prevent other instructors from providing their services or content.
- abuse Learngah resources, including support services.
2. Manual Enrollment of Learners to the Course
Learngah allows all those Tutors who are running physical institutes and classes to provide online education to their physical class students/learners by enrolling physical class students to the respective published courses manually. There is not any limit to how many learners can be enrolled manually at the moment however, from time to time, Learngah may set partial or total restriction on manual enrollments of physical class students. Further, it is totally up to the Tutors whether they would like to charge students through the Learngah or in person at their institutes.
3. Adding Customers Manually
Document Sellers are also allowed to manually add customers to the products (documents and other content) they publish. In addition, they may be able to generate manual orders for specific products against the customers they have manually added.
4. Licence to Learngah
You grant Learngah the rights detailed in the Terms of Use to offer, market, and otherwise exploit your Submitted Content. This includes the right to add captions or otherwise modify Submitted Content to ensure accessibility. You also authorize Learngah to sublicense these rights to your Submitted Content to third parties, including to students or customers directly and through third parties such as resellers, distributors, affiliate sites, deal sites, and paid advertising on third-party platforms.
We may record and use all or any part of your Submitted Content for quality control and for delivering, marketing, promoting, demonstrating, or operating the Services. You grant Learngah permission to use your name, likeness, voice, and image in connection with offering, delivering, marketing, promoting, demonstrating, and selling the Services, your Submitted Content, or Learngah’s content, and you waive any rights of privacy, publicity, or other rights of a similar nature, to the extent permissible under applicable law.
5. Trust & Safety Policies
You agree to abide by Learngah’s Trust & Safety policies and other content quality standards or policies prescribed by Learngah from time to time. You should check these policies periodically to ensure that you comply with any updates to them. You understand that your use of the Services is subject to Learngah’s approval, which we may grant or deny at our sole discretion.
We reserve the right to remove content, suspend payouts, and/or ban instructors for any reason at any time, without prior notice, including in cases where:

- an instructor or content does not comply with our policies or legal terms (including the Terms & Conditions)
- content falls below our quality standards or has a negative impact on the customer experience.
- an instructor engages in behavior that might reflect unfavorably on Learngah or bring Learngah into public disrepute, contempt, scandal, or ridicule.
- an instructor engages the services of a marketer or other business partner who violates Learngah’s policies.
- an instructor uses the Services in a way that constitutes unfair competition, such as promotion of their off-site business in a way that violates Learngah’s policies.
6. Relationship to Other Users
Tutors and Document Sellers don’t have a direct contractual relationship with students or customers, so the only information you’ll receive about students or customers is what is provided to you through the Services. You agree that you will not use the data you receive for any purpose other than providing your services to those students or customers on the Learngah platform, and that you won’t solicit additional personal data or store students or customers’ personal data outside the Learngah platform. You agree to indemnify Learngah against any claims arising from your use of students’ personal data.
7. Pricing

- Price Setting
When creating Submitted Content available for purchase on Learngah, you will be prompted to select a price for your Submitted Content. Alternatively, you may choose to offer your Submitted Content for free.
You give us permission to share your Submitted Content for free with our employees, with selected partners, and in cases where we need to restore access to accounts who have previously purchased your Submitted Content. You understand that you will not receive compensation in these cases.

- Transaction Taxes

Sellers are responsible for all kind of taxes the incur against the earnings they make at Learngah through the sale of their content. Further, for all payment methods that are handled by the Sellers such as; direct cash delivery by customer, cash on delivery, Jazz Cash, Easy Paisa, Bank Transfer and Checks, taxes and payment handling will be the sole responsibility of the Seller and it has got nothing to do with the Learngah. Similarly, if any payment or payment methods that results in customers paying money to the Learngah followed by Learngah paying the money to the Sellers (after deductions such as transaction charges, bank charges, commission or other such charges), in such scenarios Learngah will deduct any charges it incurs for payment transfer to the Seller and commission (if any, it is set to “0” for the time being but it may increase in future) and will give remaining money to the Seller through a transfer method agreed by both parties (most probably it will be Bank or Cash Transfer). Again, Sellers will be responsible to pay their taxes against the money they receive while Learngah will pay its own taxes it incurs if any, thus each party will be responsible for managing their own taxes.

- Revenue Share

Learngah provides Sellers the ability to share their knowledge, content and resources with others on a shared revenue basis, i.e. for each sale made by customer Learngah will keep a certain fixed percentage of the share of the sale (this fixed percentage is “0” for the time being and may increase in future) and the Seller will get the remaining share after excluding all the taxes and charges incurred for payment processing by Learngah. For example, if a customer purchases a course at Learngah and Learngah has to make the payment to the Seller then the Seller will get the net payment calculated after deducting payment transaction charges charged by third party for the payment made by the customer, transaction fee charged by bank or other payment service provider to transfer net payment to the Seller and after deducting the Learngah commission (if any, it is “0” for the time being and may increase in future). In addition to these charges and deductions, if Learngah incurs any other charges then they will be deducted from the payment too (such as taxes etc.) On the other hand, if the Seller directly receives payment for the content published on the Learngah then the Seller is solely responsible for all type of taxes and other deductions incurred and provided that Learngah has set a commission fee above 0 percent, the Seller will be required to pay that commission back to the Learngah and Learngah will be responsible to take care of the concerned financial matters against that sum of money. Further to this, all the payments needs to be processed in PKR.
9. Product & Course Coupons
Learngah allows the Sellers to create their own coupons or discount cards to provide discount to students or customers for the purchase they make at Learngah. With these coupons or discounts, Sellers can make a partial discount or sell the content totally free. Although Learngah allows creating coupon or discount cards however there is a limit to it which is totally at the discretion of Learngah. It is worth mentioning here that, in case any payment and other charges incurred such as; payment processing fees, transaction fees or other charges, they will be deducted from the Seller’s earning and the Seller will get earning after the deduction of these charges.
10. Refund
Customers can make a refund request within 5 days of making purchase. For all orders that are managed by the Sellers, they will be responsible to take care of the refund requests and make refund payment to the customer if they directly received the payment from the customer. Similarly, if Learngah manages any orders, i.e. order payment was processed by Learngah (in other words customer did not pay directly to the Seller) then Learngah will take care of the refund process and if approved, will make the refund payment to the customer.
Even if rejected by the Seller, Learngah will take matters into its own hands in those refund requests where:

- Customer requested refund due to the product, content, document or resource does not match the description mentioned by the seller in the product description of the course, document, content or resource. For example, a seller listed a product for Class 10 Math’s subject however when customer purchased the product then it was not math’s subject but rather English subject. This example is merely for the sake of explaining the point.
- Any other valid reason that deemed suitable to the Learngah and it asked the seller to refund the money back to the customer.
In case a seller does not comply with the (approved) refund request, depending on the severity of the situation, the Seller’s account may be suspended or terminated.
If a customer asks for a refund after we have paid the relevant Seller payment, we reserve the right to either (1) deduct the amount of the refund from the next payment sent to the Seller or (2) where no further payments are due to the Seller or the payments are insufficient to cover the refunded amounts, require the Seller to refund any amounts refunded to customers for the Sellers’s Submitted Content.
11. Receiving Payments
For all the payments managed by Learngah on the behalf of the Seller, Learngah will make the payment through either of the following methods; Bank Transfer, Jazz Cash, Easy Paisa or Checks etc. As mentioned above, you will get net payment after the deduction of all charges, commission and transaction fees incurred by the Learngah during the entire Payment Cycle.
Learngah has set a minimum earning limit, if a Seller has made more than the minimum threshold limit then only the Seller will be able to request “Money Withdrawal”. It is worth mentioning here that, if you has made a sale today and you have gone above the minimum threshold limit for withdrawal then you still have to wait at-least 7 days prior to making a withdrawal request for the order. This is wait gap is placed between the order and payment request to ensure that if customer makes a refund request and it gets approved then the sale will be reverted back to make refund to customer provided that the refund request gets approved.
12. Content Storage & Data Management
All the content you post and publish at Learngah is stored in third party data storage service providers, when someone requests it at Learngah it is delivered by those third party service providers. It is the sole responsibility of the Seller to make sure that they have their content (documents, notes, recorded video lectures and other resources) in a back-up system, cloud or file such as in your personal computers or in your cloud drives such as one drive or g-drive etc. The logic behind this is, in case there is a technical issue due to which data stored in the third part system cannot be accessed at Learngah then you should at-least have the back up with you to use it. Hence, in case of any data loss in the storage, during delivery or due to any other issue, Learngah will not be held accountable and responsible. If you have are not satisfied with this term then you should refrain yourself from registering at Learngah.
Further in order to ensure that; the video content such as recorded lectures or other supporting videos you wish to include in your course is actually yours and is not pirated, you will be required to upload your video content to Youtube, Vimeo or to your personal cloud accounts and then insert the links for such video content into your course. This way not only the content integrity can be ensured but your content will remain safe and secure and with you in case there are any technical issues faced by Learngah. In other words, all Tutors will not be allowed to upload their video content to the courses they are developing directly. Rather they will have to use third party services such as Youtube to offload their video content and then paste that content through Youtube or other such media service provider to their courses. In addition to that, if all supporting resources, that the Tutors wish to include in the courses, exceeds a file size of 5 Mega Bytes then they will be required it to upload the content to their own media storage such as G-Drive and then insert the document link into the course.
13. Deleting Your Account
Learngah can suspend or terminate your account for many reasons as mentioned above and in the Terms & Conditions document. Similarly, you can also request to terminate your account at Learngah, if that happens then we’ll use commercially reasonable efforts to make any remaining scheduled payments that are owed to you before deleting your account. You understand that if students or customers have previously enrolled or have access to your Submitted Content, your name and that Submitted Content may remain accessible to those students after your account is deleted. If you need help or encounter difficulty deleting your account, you can contact us via our Support Center.
14. Updating These Terms
From time to time, we may update these Terms to clarify our practices or to reflect new or different practices (such as when we add new features), and Learngah reserves the right in its sole discretion to modify and/or make changes to these Terms at any time. If we make any material change, we will notify you using prominent means such as by email notice sent to the email address specified in your account or by posting a notice through our Services. Modifications will become effective on the day they are posted unless stated otherwise.
Your continued use of our Services after changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.
15. Relationship Between Us
You and we agree that no joint venture, partnership, employment, contractor, or agency relationship exists between us.
